Terms of Service

1. Overview

QuoteStak LLC is a bid coordination platform that helps property owners obtain competitive bids from local contractors. These Terms are effective as of April 2026. By accessing or using QuoteStak you agree to be bound by these Terms. If you do not agree you may not use the service.

2. Services

QuoteStak provides bid gathering, comparison, and negotiation services for a flat fee. QuoteStak acts as an agent of the customer for the purpose of contractor outreach. QuoteStak does not perform construction work, employ contractors, or guarantee the quality of any contractor's work. QuoteStak is not a licensed contractor, general contractor, or contractor referral service. QuoteStak checks contractor license status against the Washington State Department of Labor & Industries public registry and displays the result for informational purposes only. This verification may be incomplete or out of date, and a result of "License not verified" means QuoteStak could not confirm a matching record, not that the contractor is unlicensed. QuoteStak does not independently verify contractor insurance or bonding. Property owners remain responsible for their own due diligence and for verifying contractor credentials before hiring. QuoteStak makes no warranty or representation regarding any contractor's licensure, bonding, or work quality. Cost estimates provided by QuoteStak are generated using AI and publicly available market data. Estimates are for informational purposes only and do not constitute a guarantee of actual contractor pricing. Final bid amounts are determined solely by contractors.

You contract directly with licensed contractors. QuoteStak is software that helps property owners gather and compare bids; it is never a party to your agreement with a contractor and never supervises or performs the work.

3. Contractor outreach authorization

When a customer purchases a QuoteStak bid service the customer expressly authorizes QuoteStak LLC to act as their agent for the purpose of contacting local contractors. This authorization includes sending SMS messages and emails to contractors on the customer's behalf using the customer's name and project address. By purchasing a QuoteStak service the customer represents that they are the owner or authorized agent of the property listed and that the property address provided is accurate. All contractor outreach is initiated solely in response to a customer purchase and explicit authorization. QuoteStak does not conduct unsolicited mass outreach. Every contractor contact is tied to a specific customer request for a specific project at a specific property address. Contractors who receive outreach from QuoteStak may reply STOP at any time to opt out of future project inquiries. QuoteStak maintains opt-out records and honors all opt-out requests immediately and permanently.

4. SMS Communications

QuoteStak uses SMS messaging to coordinate contractor bids on behalf of paying customers. By purchasing a QuoteStak service you authorize QuoteStak to send SMS messages to contractors on your behalf.

Contractors who receive SMS messages from QuoteStak may opt out at any time by replying STOP. All opt-out requests are honored immediately and permanently. Contractors may reply HELP for assistance.

5. Payment and refunds

QuoteStak charges a flat fee per project. Contractor outreach begins immediately after payment. If QuoteStak is unable to find enough qualified contractors for your project you will receive a full automatic refund. If QuoteStak is unable to deliver the full number of bids purchased after exhausting the available contractor pool QuoteStak will issue a partial refund based on the number of undelivered bids. Partial refunds are issued automatically to the original payment method within 5 to 10 business days. All payments are processed securely through Stripe.

6. Limitation of liability

QuoteStak facilitates introductions between property owners and contractors. QuoteStak is not responsible for the quality, timeliness, or outcome of any construction work performed by contractors. QuoteStak provides its services on an as-is and as-available basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. In no event shall QuoteStak be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of its services or any contractor introduced through the platform, even if QuoteStak has been advised of the possibility of such damages. QuoteStak's liability is limited to the flat fee paid for the service.

7. Account termination

You are responsible for maintaining the security of your account credentials. QuoteStak reserves the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity. You may close your account at any time from your account settings.

8. Account deletion

You may request deletion of your account and all associated data at any time from your account settings. QuoteStak will fulfill all deletion requests within 30 days in compliance with CCPA.

9. Governing law

These Terms are governed by the laws of the State of Washington. Any disputes arising under these Terms shall be resolved through binding arbitration administered by JAMS under its Streamlined Arbitration Rules, conducted in Seattle, Washington. You waive any right to participate in a class action lawsuit against QuoteStak.

10. Prohibited uses

You may not use QuoteStak to submit false or fraudulent project requests, impersonate another person or property owner, or attempt to contact contractors sourced through QuoteStak outside of the platform for the purpose of bypassing payment. Violation of these prohibitions may result in immediate account termination without refund.

11. Changes to these terms

QuoteStak reserves the right to update these Terms at any time. Material changes will be communicated by email to the address associated with your account. Continued use of the service after changes are posted constitutes acceptance of the updated Terms.
